Djurskydd är något som engagerar i samhället. Vad som anses vara en acceptabel djurhållning regleras i djurskyddslagstiftningen, som består av lag, förordning och föreskrifter. Genom åren har det skett ändringar av såväl organisationen av djurskyddsarbetet som själva lagstiftningen. På senare tid har en del röster hörts i samhällsdebatten, till exempel politiker, forskare, konsumentorganisationer och djurskyddsorganisationer, kring att djurens välfärd får stå tillbaka för produktionsintressen. Frågan är om dessa farhågor har en reell grund. Huvudsyftet med denna studie har varit att analysera hur djurskyddsföreskrifterna förändrats från år 1988 och fram tills idag. De mer specifika frågeställningarna som berörts har handlat om hur uppdragen och ansvarsbeskrivningarna till den centrala (föreskrivande) myndigheten (härefter "myndigheten") sett ut, hur föreskriftsförändringarna står sig i förhållande till djurskyddslagens intentioner, samt hur dessa förändringar i både sak och struktur påverkat djurskyddet och djurens välfärd. En särskild frågeställning har varit huruvida föreskriftsändringarna byggt på vetenskapliga fakta, eller om andra faktorer, intressen och värderingar vägt tyngre. Slutligen handlade en frågeställning om hur utvecklingen skett i andra europeiska länder, för att sätta resultaten i ett större sammanhang. Studien avgränsades till djurslagen nöt, gris och häst. Föreskrifter, remissutskick och remissammanställningar/remissvar från 1988 har analyserats med syftet att utvärdera vilka förändringar som skett. I ett nästa steg togs 77 regler ut utifrån ett antal kriterier. Varje regel granskades därefter hur myndigheten motiverat sitt förslag, vad remissinstanserna ansett om förslaget, om någon instans vägt tyngre än någon annan, samt om den slutliga formuleringen skiljde sig åt från det remitterade förslaget. Även propositionerna till djurskyddslagen (1944, 1988 och 2019) har analyserats, liksom den centrala myndighetens instruktioner, regleringsbrev och regeringsuppdrag, tillika utredningar och rapporter vilka haft eller har betydelse för djurskyddet/djurvälfärden. Ett frågebatteri rörande nationella djurskyddsregler sändes ut till djurskyddskunniga i 15 europeiska länder. Resultatet av analyserna visar att det svenska djurskyddsregelverket ändrats mycket sedan 1988. År 1988 fanns det enbart allmänna råd avseende nöt, gris och häst. De första bindande föreskrifterna utkom 1989 och var då mer omfattande för nöt än för gris, och båda dessa djurslag hade betydligt mer omfattande föreskrifter än för häst. År 1993 fick tävlingshästarna lite mer omfattande föreskrifter, dock började föreskrifterna gälla alla hästar (oavsett hästhållning) först 2003. Utifrån analysen har djurskyddsföreskrifterna generellt stärkts för alla tre djurslag sedan 1988. För nötkreaturen har det till exempel införts förbud mot uppbundna handjur, krav på lösdrift för alla nötkreatur i samband med nyeller ombyggnad, samt att spaltgolv endast får förekomma i värmeisolerade stallar och vara belagt med gummi eller annat eftergivligt material. För grisar har till exempel krav på bobyggnadsmaterial till suggor, krav på strö för sysselsättning och komfort, samt krav på fri tillgång till vatten stärkt djurskyddet. För hästar har djurskyddsnivån höjts genom till exempel begränsning av hur länge en häst får stå bunden i spilta, förbud mot nybyggnation av spiltor för stadigvarande uppstallning, krav på social kontakt och krav på daglig fri rörelse i alla gångarter (i första hand utomhus). Det har dock även förekommit föreskriftsförändringar där det är svårt att uttala sig om huruvida djurskyddet har förändrats och i så fall på vilket sätt, samt om ändringarna de facto sänkt djurskyddsnivån. Förändringarna i de senaste hästföreskrifterna, där funktionskrav ersatt resurskrav och de allmänna råden i princip helt tagits bort, är exempel på förändringar där det är svårt att avgöra vilken inverkan dessa får på djurskyddsnivån i praktiken. Jordbruksverkets syfte är att det inte ska innebära en sänkning av djurskyddsnivån, utan tvärtom. Många remissinstanser ser dock risken att ändringen 5 kommer att innebära att såväl djurägare som djurskyddsinspektörer kommer göra fler skilda bedömningar, vilket ger en ökad rättsosäkerhet och mindre förutsägbarhet, såvida inte Jordbruksverket förstärker sin kontrollvägledning gentemot länsstyrelserna och satsar mer på information ut till djurägarna. Av de regler som analyserades avseende ändringar så visade 45 % helt eller delvis någon form av djurskyddshöjning, 19 % helt eller delvis en sänkning samt 30 % där det inte varit helt möjligt att avgöra djurskyddskonsekvenserna. Att nivån höjts är dock inte detsamma som att en optimal djurskyddsnivå eller djurvälfärdsnivå uppnåtts. Av analysen framgick det att vid framtagandet av förslag på föreskrifter hade myndigheten samrått med näringens organisationer i samtliga fall när samråd hållits. Vid 50 % av samråden var näringens organisationer myndighetens enda samrådspartners, andra intressenter än näringen var närvarande vid samrådsmöten resterande 50 % av fallen. Vid 71 % av regelförslagen motiverade myndigheten ändringen med förbättringar av djurvälfärden, 38 % av förslagen motiverades helt eller delvis utifrån djurhållarens perspektiv och 14 % av förslagen motiverades avseende ändringar i EU-lagstiftningen eller införlivandet av den svenska djurskyddslagen. Det kan dock ifrågasättas om vissa förändringar verkligen har skett av omsorg om djuren. Myndigheten hänvisade sällan till forskningsfakta vid motiveringen av föreskriftsförslag. Då myndigheten väl gjorde detta kunde det ske på ett inkonsekvent sätt avseende hanteringen av och resonemangen kring forskningsresultaten. Av ändringsförslagen innehöll 57 % inga resonemang alls kring vetenskapliga fakta, i 16 % av förslagen fanns uppgift om att "forskning finns", utan att hänvisa till den forskning som avsågs, eller till uppgiften att "forskning saknas". För tydlighetens skull ska sägas att då myndigheten inte hänvisat till forskning, så är det inte detsamma som att forskningsstöd saknats. Det går inte heller att få stöd i forskning för allt som regleras i lagstiftningen, och forskningsresultat är inte heller alltid entydiga. Remissvaren till myndigheten, vilka inkommit från olika intressenter har varierat i kvalité. Av de 77 analyserade regeländringarna så har remissinstanserna överlag varit positiva till 31 %, negativa till 22 %, skeptiska till 18 %, samt vid 8 % av förslagen så har hälften varit för och hälften emot. Av regelförslagen har myndigheten ändrat 32 % av reglerna i sak efter remissrundan, 61 % har inte ändrats i sak. Av förändringarna innebar 12 % en höjning av djurskyddet och 9 % en sänkning. Att märka är att det är vanligare att föreskrifterna inte ändras i sak, än att de ändras efter att remissinstanserna sagt sitt. Detta kan innebära att det är större chans för en intressegrupp att påverka föreskriftsarbetet innan, i samrådsskedet, än efter det att förslaget skickats ut på remiss. Ser man per djurslag har flest remissinstanser varit kritiska till föreskriftsändringarna gällande häst. För majoriteten av förslagen (68 %) var det inte tydligt utifrån dokumentationen att någon remissinstans eller intressegrupp vägde tyngre än en annan grupp under remissomgången. Det kan konstateras att djurskydds-, djurrätts- eller konsumentorganisationers åsikter aldrig varit tyngst vägande, de har dock i vissa fall fått gehör för sina åsikter om andra remissinstanser haft samma uppfattning. De föreskriftsförändringar som skett och det sätt som myndigheten uttryckt sig på återspeglar vilka direktiv myndigheten fått av regeringen, via instruktioner, regleringsbrev, utredningar m.m. Innan 2007 var det tydligt att det strävades efter en höjd djurskyddsnivå och ett detaljerat regelverk. Sedan 2007 uttrycks det istället oftast så att djurskyddnivån ska bibehållas, att man ska minska på detaljnivån, öka flexibiliteten och ha ett mer målinriktat regelverk. Sverige har sedan 2019 en ny djurskyddslag där intentioner är högre än i den tidigare djurskyddslagen. De förhållningsorder Jordbruksverket får från regeringen är allt annat än entydiga. Å den ena sidan kan den politiska 6 ambitionsnivån för djurskyddet upplevas som lägre än tidigare, och å den andra sidan som högre. Det är därför kanske inte konstigt om hanteringen av föreskrifterna kan upplevas som inkonsekvent för utomstående. Även om Sverige står sig bra i jämförelse med andra länder, inklusive flertalet av EU:s medlemsstater, avseende omfattning och nivå på djurskyddslagstiftningen så pågår ständig utveckling och förbättring runt om i världen. Svenskt djurskydd har högt anseende bland svenska konsumenter och medborgare, för att detta anseende ska bibehållas behöver även svenskt djurskydd förbättras och utvecklas.

Simple Summary: Sweden is often cited as a leading country in animal welfare and related legislation, but some recent changes in the national legislation are seen as lowering the animal welfare requirements in order to improve the competitiveness of Swedish farmers. In this study, we analysed suggested changes to the Swedish welfare legislation between 1988 and 2019 relating to horses, cattle and pigs, including the written motivations, the written stakeholder responses and the actual changes to the final regulations. We used a sample of 77 legal requirements to assess in depth whether the animal welfare level was affected by these changes in the legislation. The results showed that the animal welfare requirements in Sweden for cattle, pigs and horses increased overall during the 30-year study period, but that a number of specific requirements had been relaxed to satisfy interests other than animal welfare. Thus, the new requirements should be evaluated more fully in order to determine whether they serve their purpose in practice. Sweden is often seen as a leading country in animal welfare and legislation, but some recent amendments to the legislation are perceived as relaxing animal welfare requirements in order to improve the competitiveness of the relevant industry and of farmers. In this study, we analysed the suggested and actual changes in the Swedish national animal welfare regulations relating to horses, cattle and pigs between 1988 and 2019 and the consequences for the intended animal welfare level. The regulations and amendments, including the proposals, the written motivations, the stakeholders' written responses to the proposed amendments and the final amendments, were scrutinised in detail. A sample of 77 requirements was then selected to assess whether and how the animal welfare level was affected by these legislative changes. The results indicated that the animal welfare protection level for cattle, pigs and horses increased overall during the 30-year period, but that a number of specific requirements had been relaxed to meet objectives other than animal welfare. It was more difficult to determine whether animal welfare improved in practice during the same period, due to the lack of systematic evaluations of the consequences of amending the regulations. Future evaluations are needed to evaluate the outcome of new legislative requirements and to monitor whether they serve their purpose in practice.

Simple Summary: In all European countries, farmers keeping animals must comply with European and national animal welfare legislation. Each government has a responsibility to make sure that the legislation is complied with by the farmers. However, during the last decades it has become increasingly common that private organisations, such as the industry, farmers' organisations, or animal welfare organisations, develop additional animal welfare regulations (private standards') that the farmers also need to comply with. These private standards have the opportunity to improve animal welfare above the legislative level, however, in our study we have shown that this is not always the case and that all of these different private standards, in addition to the legislation, makes it difficult to get an overview of the animal welfare regulation and control arena. For the sake of the farmers, the animal welfare inspectors, the consumers, and the animals we conclude that it is important that policymakers consider this arena as a whole and not their own regulation as a single phenomenon.Abstract The current shift moves the governance of animal welfare away from the government towards the private market and the consumers. We have studied the intentions, content, and on-farm inspection results from different sets of animal welfare legislation and private standards with an aim to highlight the most important opportunities and risks identified in relation to the trend of increasingly relying on private standards for safeguarding or improving farm animal welfare. Our results show that different focuses, intentions, animal welfare requirements, inspection methods (i.e., methods for measuring and evaluating the compliance with a regulation), and inspection results, together with the use of vague wordings and a drive towards more flexible regulations does certainly not facilitate the interpretation and implementation of animal welfare regulations, especially not in relation to each other. Since farmers today often have to comply with several animal welfare regulations, including private standards, it is important to stress that a given regulation should never be seen as a single, stand-alone phenomenon, and the policymakers must hence consider the bigger picture, and apply the standards in relation to other existing regulations. This is especially relevant in relation to the legislation, a level that a private standard can never ignore.

SIMPLE SUMMARY: Harness racing is the most common form of horse racing in Sweden. As public awareness of animal welfare is increasing, the welfare of these horses must be ensured. Trotting horse trainers in Sweden undergo an official animal welfare inspection by the County Administrative Board (CAB) and a private inspection by their own association, the Swedish Trotting Association (STA). This study investigated trainers' perceptions of these different inspections using a digital questionnaire sent out during spring 2021. Of the 396 responding trainers, a majority reported quite positive experiences of both CAB and STA inspections. However, most perceived the STA inspections to be more valuable and the STA inspectors to be more competent than the CAB inspectors. Overall, the competence and manner of the inspector had a stronger association with trainers' perceptions of an inspection than the results of the inspection. While trainers were generally satisfied with the control system, they would like better coordination between the different inspections. ABSTRACT: In Sweden, the County Administrative Board (CAB) and Swedish Trotting Association (STA) both perform animal welfare inspections of the premises of trotting horse trainers. The CAB inspection checks for compliance with the legislation, and the STA inspection checks for compliance with the private 'Trotter Health Standard', which mainly sets the same requirements as the legislation. This study investigated the views of trainers on these inspections both as separate events and in relation to each other. A digital questionnaire was sent out to trotting horse trainers in Sweden during spring 2021, and 396 trainers responded. Descriptive and statistical analyses were used to evaluate the responses. However, the inspectors did not categorize all farms with dirty cattle as non-compliant, mainly using the argument that only a few animals were dirty. Therefore, in addition to knowing what characterizes 'clean enough' cattle, both inspectors and farmers need better guidance on when a farm is compliant, or non-compliant, with animal welfare legislation.
